§ 9 Revocation

Merchcowboy grants the customer that is a consumer the statutory revocation rights in distance selling:

You may revoke your contractual statement without giving reasons within two weeks in writing (e.g. letter, fax, email) or – if the item has been transferred to you before the expiry date – by returning the item. The term commences after receiving these instructions in writing but not before the recipient receives the goods (with repeat deliveries of similar goods not before the first partial delivery is received). To maintain adherence to the term, we have to make available to you as a consumer in the case of electronic orders online arrangements to assist in identifying input errors and related details, which also includes significant information about signing the agreement and its content, the contractual language and storage of the contract wording. Plus we must again notify you of important information about the offer and the agreement in writing (e.g. letter, fax, email).

To meet the revocation time limit, it is sufficient to send the revocation or item promptly.

Revocation rights are excluded in the case of deliveries of merchandising items that are produced according to customer specifications or clearly tailored to personal requirements. This applies especially to the merchandising items ordered by request. Revocation rights are also excluded for the delivery of tickets and audio or video recordings, if the consumer has broken the seals on the media supplied.

Consequences of revocation

In case of a valid revocation, all mutually received performances as well as emoluments taken (e.g. interest), if applicable, are to be returned by either side. If you are unable or partially unable to return the merchandise to us or can only return it in a deteriorated condition, then you have to compensate us for its value if necessary. This does not apply if the deterioration is exclusively due to examining the merchandise, such as in a retail store. If deterioration occurs due to putting the merchandise to its intended use, you do not have to compensate for its value.

Items that can be shipped by parcel are to be returned at our risk. You are obliged to bear the costs of the return shipment, if the merchandise delivered corresponds to the merchandise ordered, and if the price of the merchandise to be returned does not exceed €40 or if, where the price is higher, you have at the date of revocation not yet rendered consideration or given a part payment. In all other cases, the return shipment is free of charge to you. We request, however, even in cases where Merchcowboy is obliged to provide reimbursement, that you affix sufficient stamps. Items that cannot be shipped by parcel will be picked up from you. All reimbursement obligations must be fulfilled within 30 days. The time limit commences for you on the date your declaration of revocation or the item is sent; for us it is the date of receipt.
